IS PAYING TAXES TO THE TÂGHÛT SHIRK OF OBEDIENCE?

In a country I know of it is expected to pay the government tax for houses or cars you own. If you do not pay the tax then the house or car will be taken from you.

Furthermore unlike other countries this tax money is not automatically removed from your salary or bank account by the government. Rather it is expected the person voluntarily goes to pay the tax in a certain place etc. If they do not pay they will be fined and eventually if they do not pay the above the house or car will be taken.

What is the huqm on someone who pays this tax for their house or car in this situation?

Furthermore Would this fall under shirk of obedience?

Bismillâh.

Paying taxes is something that has existed since the beginning of humanity. The Kuffâr collect taxes from Muslims and the Muslims collect taxes from the Kuffâr. Paying taxes has nothing to do with Kufr or Shirk. Our advice to you is to first learn Tawhîd and its opposite Shirk and Kufr. If you are benefitting from trade in the land of the Kuffâr and are benefiting from a blessing in their country, they may demand a share of the benefit you have obtained from you under the name of tax. The issue has nothing to do with Shirk of obedience. In the Shirk of obedience, a right that belongs to Allâh is given to other than Him. This is not the case when paying taxes. Of course, the situation is as such when the tax-related procedures do not contain Kufr. You mentioned transactions with the bank etc., it is possible that the transaction done at the banks have Kufr and interest-based terms, and one cannot conduct such a contract with the bank. We hope that such questions will decrease as you learn authentic Tawhîd.

Imâm Abû Yûsuf Rahmatullâhi Alayh narrates the following with its chain of narration under the title of "Treating Ahl'ul Harb Equally",


كَتَبَ أَبُو مُوسَى الْأَشْعَرِيّ إِلَى عمر ابْن الْخَطَّابِ أَنَّ تُجَّارًا مِنْ قِبَلِنَا مِنَ الْمُسْلِمِينَ يَأْتُونَ أَرْضَ الْحَرْبِ فَيَأْخُذُونَ مِنْهُمُ الْعُشْرَ، قَالَ فَكَتَبَ إِلَيْهِ عُمَرُ: خُذْ أَنْتَ مِنْهُمْ كَمَا يَأْخُذُونَ مِنْ تُجَّارِ الْمُسْلِمِينَ

"Abû Mûsâ al-Ash'arî Radiyallâhu Anh wrote a letter to Umar Ibn'ul Khattâb Radiyallâhu Anh stating, 'The Muslim merchants from us go to the abode of Harb and they take a tenth from them.' Thereupon, Umar Radiyallâhu Anh wrote to him, 'You should take (taxes) from them as they take from the Muslim merchants!" (Abû Yûsuf, al-Kharâj, p. 148-149)

As understood from the narration we cited, if giving taxes to a Kâfir was Kufr, Umar Radiyallâhu Anh who was from the rightly guided caliphs and the scholars who narrated this and used this narration as evidence would have known this before you and us. Leave aside the doubts spread by the ignorant and follow the path of the Salaf. And Allâh knows best.

Ibnu Aqîl Rahimahullâh said, "If you want to learn the status of Islâm among contemporary people, then do not look at their crowds at the doors of the mosques and their crying Labbayk at the Mawqif (during Hajj). On the contrary, look at their collusion with the enemies of the Sharî'ah!" (Ibnu Muflih, al-Âdâb'ush Sharî'ah, 1/237)
