KHUURUJ & JIHAAD TODAY?

Bismillahirrahmanirrahim,

Hamidan wa Musalliyan wa Ba'd;

In diverse areas around the world there exist many structured groups which claim they are doing Jihaad. These groups and their supporters claim, they are doing these acts of supposed Jihaad in the name of Islam and relate themselves to this religion. We do know and have acknowledged that these claims are irrelevant and insufficient. We reproach and reject them and their actions. They are not what they claim to be. They are not Muslim; we witness and attest to the fact that their actions have no relation to Islam.

There are clear and very evident differences between that which are done today on the face of this earth under the banner of supposed Jihaad and the struggles that Muslimin go through to strengthen and lift all Dhulm (oppression/tyranny) and Fisq (corruption) off from the face of the earth and to establish the Din to Allah alone.

Without getting into too much detail we will try to explain some of this Inshallah.

What needs to be established here is that; all the Diyaar (lands) which used to be Dar'ul Islam (the Abode of Islam) need to be saved from the invasion of the Kuffar and be reinstated under the Hakimiyyah (authority) of Islam as a whole and not  by doing Khuruj (rebellion) on administration one by one. However this requires strength. On the contrary if this is not done in the manner it is suppose to be done, by a few people coming together with arms resisting against the organized forces of the Kuffar will result on the contrary to loss and harm to the Din, the wealth, the life and honor. Allah has not held man kind responsible with such things. It is also not permissible to command people to do things that Allah had not held them responsible with and to do, to act upon that which will cause the corruption of Dunya (world).

Allah (Azza wa Jallah) stated:


يَا أَيُّهَا الَّذِينَ آمَنُوا إِذَا لَقِيتُمُ الَّذِينَ كَفَرُوا زَحْفًا فَلَا تُوَلُّوهُمُ الْأَدْبَارَ وَمَنْ يُوَلِّهِمْ يَوْمَئِذٍ دُبُرَهُ إِلَّا مُتَحَرِّفًا لِقِتَالٍ أَوْ مُتَحَيِّزًا إِلَى فِئَةٍ فَقَدْ بَاءَ بِغَضَبٍ مِنَ اللَّهِ وَمَأْوَاهُ جَهَنَّمُ وَبِئْسَ الْمَصِيرُ

"O you who believe! When you meet those who disbelieve, in a battlefield, never turn your backs to them. And whoever turns his back to them on such a day - unless it be a stratagem of war, or to retreat to a troop (of his own)- he indeed has drawn upon himself wrath from Allah. And his abode is Hell, and worst indeed is that destination!" (al-Anfal 8/15-16)

In the Tafsir of these Ayaat Imam al-Qurtubi (rahimahullah) stated:


قَالَ ابْنُ الْقَاسِمِ: لَا تَجُوزُ شَهَادَةُ مَنْ فَرَّ مِنَ الزَّحْفِ، وَلَا يجوز لهم الفرار وإن فر إمامهم، وَمَنْ يُوَلِّهِمْ يَوْمَئِذٍ دُبُرَهُ الْآيَةَ. قَالَ: وَيَجُوزُ الْفِرَارُ مِنْ أَكْثَرَ مِنْ ضِعْفِهِمْ، وَهَذَا مَا لَمْ يَبْلُغْ عَدَدُ الْمُسْلِمِينَ اثْنَيْ عَشَرَ أَلْفًا، فَإِنْ بَلَغَ اثْنَيْ عَشَرَ أَلْفًا لَمْ يَحِلَّ لَهُمُ الْفِرَارُ وَإِنْ زَادَ عَدَدُ الْمُشْرِكِينَ عَلَى الضِّعْفِ، لِقَوْلِ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وَسَلَّمَ:" وَلَنْ يُغْلَبَ اثْنَا عَشَرَ أَلْفًا مِنْ قِلَّةٍ" فَإِنَّ أَكْثَرَ أَهْلِ الْعِلْمِ خَصَّصُوا هَذَا الْعَدَدَ بِهَذَا الْحَدِيثِ مِنْ عُمُومِ الْآيَةِ. قُلْتُ: رَوَاهُ أَبُو بِشْرٍ وَأَبُو سَلَمَةَ الْعَامِلِيُّ، وَهُوَ الْحَكَمُ بْنُ عَبْدِ اللَّهِ بْنِ خَطَّافٍ وَهُوَ مَتْرُوكٌ. قَالَا: حَدَّثَنَا الزُّهْرِيُّ عَنْ أَنَسُ بْنُ مَالِكٍ عَنْ رَسُولِ اللَّهِ صَلَّى اللَّهُ عَلَيْهِ وغلم قَالَ: (يَا أَكْثَمُ بْنَ الْجَوْنِ اغْزُ مَعَ غَيْرِ قَوْمِكَ يَحْسُنُ خُلُقُكَ وَتَكْرُمُ عَلَى رُفَقَائِكَ. يَا أَكْثَمُ بْنَ الْجَوْنِ خَيْرُ الرُّفَقَاءِ أَرْبَعَةٌ وَخَيْرُ الطَّلَائِعِ أَرْبَعُونَ وَخَيْرُ السَّرَايَا أَرْبَعُمِائَةٍ وَخَيْرُ الْجُيُوشِ أَرْبَعَةُ آلَافٍ وَلَنْ يُؤْتَى اثْنَا عَشَرَ أَلْفًا مِنْ قِلَّةٍ (. وَرُوِيَ عَنْ مَالِكٍ مَا يَدُلُّ عَلَى ذَلِكَ مِنْ مَذْهَبِهِ وَهُوَ قَوْلُهُ لِلْعُمَرِيِّ  الْعَابِدِ إِذْ سَأَلَهُ هَلْ لَكَ سَعَةٌ فِي تَرْكِ مُجَاهَدَةِ مَنْ غَيَّرَ الْأَحْكَامَ وَبَدَّلَهَا؟ فَقَالَ: إِنْ كَانَ مَعَكَ اثْنَا عَشَرَ أَلْفًا فلا سعة لك في ذلك.

"Ibn’ul Qasim stated: As the Shahadah (witness) of the one who flees war is not permissible (accepted), it is not permissible for them to flee from war even if their Imam flees. This is because Allah commands: "And whoever turns his back to them on such a day" (al-Anfal 8/15) and again He said: It would be permissible to flee from war if they came across the enemy who are more than double. However, it is like this when the number of the Muslimin is under twelve thousand. If their number reach twelve thousand then fleeing is not permissible even if the number of their enemy is double in size. Since Rasulullah (sallallahu alayhi wa sallam) stated: "Twelve thousand Muslims will not be defeated for lack of numbers." Most of the Ahl Ilm (i.e., People of Sacred-Knowledge) accepted the army which reach the amount (of twelve thousand or more) out of the general ruling of the Ayah and made Takhsis (qualification, specification; one verse limiting or restricting a general ruling found in another verse).

I (i.e., Qurtubi) say: This was related by Abu Bishr and Abu Salama al-Amili. Abu Salama as known as al-Hakam ibn Abdullah ibn Khuttaf and is a Matruk (rejected) Rawi (narrator). They both said: Zuhri narrated us from Anas ibn Malik and he narrated from Rasulullah (sallallahu alayhi wa sallam) that he said:

"Oh Aksam ibn'ul Jawn, go to Ghazwa (military expedition) with people are not from your Qawm (tribe) so that your character gets better and you treat your friends in a better way. Oh Aksam ibn'ul Jawn: The best group of friends is four, and the best of the watch guards is 40 and the best expedition is 400, and the best host is 4,000. An army of 12,000 shall not suffer on account of inferior numbers, and shall not be defeated." (Ibn Maajah; Abu Dawud; Tirmidhi)

There are narrations from Imam Malik which indicates that he also on the same view. And it was the statement of him which he said to al-Umari al-Abid. al-Umari asked to him: Is it open for us not to join a battle against those abandoning Allah’s law in favor of a different law? Malik answered: If you have 12,000 with you, you may not stay behind."

The above-mentioned Hadith also narrated with the Ziyada (addition) words: "if they are truly united meaning hearts beating as one." For this reason Imam Muhammad and also the Sharih (commentator) Sarahsi explained this Hadith as: "When they are truly united (their statements and Niyyah are one), it is not permissible for an army of 12.000 to flee from their enemy." (Sarahsi, Sharh’us Siyar’il Kabir, 1/68)

When the enemy is twice the size of the Muslimin the evidence that it is permissible to flee is in the following Ayaat:


يَا أَيُّهَا النَّبِيُّ حَرِّضِ الْمُؤْمِنِينَ عَلَى الْقِتَالِ إِنْ يَكُنْ مِنْكُمْ عِشْرُونَ صَابِرُونَ يَغْلِبُوا مِائَتَيْنِ وَإِنْ يَكُنْ مِنْكُمْ مِائَةٌ يَغْلِبُوا أَلْفًا مِنَ الَّذِينَ كَفَرُوا بِأَنَّهُمْ قَوْمٌ لَا يَفْقَهُونَ الْآنَ خَفَّفَ اللَّهُ عَنْكُمْ وَعَلِمَ أَنَّ فِيكُمْ ضَعْفًا فَإِنْ يَكُنْ مِنْكُمْ مِائَةٌ صَابِرَةٌ يَغْلِبُوا مِائَتَيْنِ وَإِنْ يَكُنْ مِنْكُمْ أَلْفٌ يَغْلِبُوا أَلْفَيْنِ بِإِذْنِ اللَّهِ وَاللَّهُ مَعَ الصَّابِرِينَ

"O Prophet! Urge the believers to fight. If there are twenty steadfast persons among you, they will overcome two hundred, and if there be a hundred steadfast persons they will overcome a thousand of those who disbelieve, because they (the disbelievers) are people who do not understand. Now Allah has lightened your (task), for He knows that there is weakness in you. So if there are of you a hundred steadfast persons, they shall overcome two hundred, and if there are a thousand of you, they shall overcome two thousand by the leave of Allah. And Allah is with the patient." (al-Anfal 8/65-66)

Regarding these Ayaat, Ibn Kathir (rahimahullah) stated:


وَقَالَ مُحَمَّدُ بْنُ إِسْحَاقَ: حَدَّثَنِي ابْنِ أَبِي نَجِيحٍ، عَنْ عَطَاءٍ، عَنِ ابْنِ عَبَّاسٍ، قَالَ: لَمَّا نَزَلَتْ هَذِهِ الْآيَةُ ثَقُلَتْ عَلَى الْمُسْلِمِينَ، وَأَعْظَمُوا أَنْ يُقَاتِلَ عِشْرُونَ مِائَتَيْنِ، وَمِائَةٌ أَلْفًا، فَخَفَّفَ اللَّهُ عَنْهُمْ فَنَسَخَهَا بِالْآيَةِ الْأُخْرَى فَقَالَ: {الآنَ خَفَّفَ اللَّهُ عَنْكُمْ وَعَلِمَ أَنَّ فِيكُمْ ضَعْفًا} الْآيَةَ، فَكَانُوا إِذَا كَانُوا عَلَى الشَّطْرِ مِنْ عَدُوٍّ لَهُمْ لَمْ يَنْبَغِ لَهُمْ أَنْ يَفِرُّوا مِنْ عَدُوِّهِمْ، وَإِذَا كَانُوا دُونَ ذَلِكَ، لَمْ يَجِبْ عَلَيْهِمْ قِتَالُهُمْ، وَجَازَ لَهُمْ أَنْ يَتَحَوَّزُوا عَنْهُمْ.
وَرَوَى عَلِيُّ بْنُ أَبِي طَلْحَةَ وَالْعَوْفِيُّ، عَنِ ابْنِ عَبَّاسٍ، نَحْوَ ذَلِكَ. قَالَ ابْنُ أَبِي حَاتِمٍ: وَرُوِيَ عَنْ مُجَاهِدٍ، وَعَطَاءٍ، وَعِكْرِمَةَ، وَالْحَسَنِ، وَزَيْدِ بْنِ أَسْلَمَ، وَعَطَاءٍ الْخُرَاسَانِيِّ، وَالضَّحَّاكِ نَحْوُ ذَلِكَ.


"Muhammad Ibn Ishaq says: According to the narration of Ibn Abu Najih from Ata and he narrated from Ibn Abbas (radiyallahu anhuma ajmain) that he said: When this Ayah was revealed it was hard on the Muslimin and it became great (too much) in their eyes that twenty could fight with two hundred and a hundred could fight a thousand. Allah Ta’ala lightened their burden with another Ayah and commanded: "Now Allah has lightened your (task), for He knows that there is weakness in you." (al-Anfal 8/66) Thereafter, if Muslims were half as many as their enemy, they were not allowed to run away from them. If the Muslims were fewer than that, they were not obligated to fight the disbelievers and thus allowed to avoid hostilities. A similar view was narrated bu Ali ibn Abu Talib (radiyallahu anh) and Awfi from Ibn Abbas (radiyallahu anhuma ajmain). Ibn Abu Hatim said a similar was narrated by Mujahid, Ata, Ikrimah, Hasan, Zayd ibn Aslam, Ata al-Khorasani and Dahhaq."

Our intention here is not to get into detail regarding Khuruj against the Kafir administrators nor is it about what the count of the Islamic army needs to be. The aim of narrating these is to express the fact that in order to act upon the Wajibat (obligatories) of revolting against the Kafir government or in order to expel the Kuffar from the invaded Diyaar of Islam; these acts are dependent on the strength of the Muslimin whether just numerically, militarily, or politically etc.  If not then the command of fighting the Kuffar, i.e., Jihaad can only be taken in the Dhahir and if the needed conditions are not observed then many non permissible acts will take place. We now live in an era which Islam has returned to its strangeness as it had begun and in an era which the Ahl-i Tawhid are next to none. For this reason what really needs to be done in such era is, to call to the Aqidah (creed) of Tawhid and to have patience in the things that have to be faced as a consequence. Strength needs to be gained alongside the true Din. Without placing the Aqidah of Tawhid within masses this so called Jihaad that is being acted upon will not have any relation to its real counterpart. With a hand full of Muwahhid how far will you get without the support of the people? For this reason in reality we see those who claim Tawhid even make concession from their Aqidah mixed with Haqq (truth) and Baatil (falsehood). While trying to act upon the Fard (obligatory) of Jihaad losing Tawhid which is the Asl (base) of all Asl, leading to eternal disappointment is just plain stupidity. Also it need be said that this movement that is yet in process of developing is being destroyed by being pulled into such provocative movements which is exactly what the Tawaghit (pl., Taghout) want and most the time it is what they actually direct them selves. Today many examples of this are seen.
   
In short the Fard to make Khuruj against the Tawaghit can only be established if a strong organization is available in all areas, this is not an ordinary Hukm (ruling). Whether or not such conditions are met will change according to time and place. While a certain area could be ready in a certain time another area may not be ready at the same time, it may take longer for it to be ready. This decision will be made by those owners of Basirah (foresight) and Ilm (knowledge) from among the Muslimin. Today it is too soon to even think about such action since an Islamic Jama’ah (community) as such hasn’t even been formed. What is obligated upon the Ahl-i Tawhid is to stand steadfast in Dawah (call; message) to Tawhid just as Nuh (alayhi salam) did for 950 years.

Whosoever desires الْعِزَّةَ al-Izzah (honour, power and glory) then to Allah belong all الْعِزَّةَ al-Izzah [and one can get honour, power and glory only by obeying and worshiping Allah (Alone)]. To Him ascend (all) الْكَلِمُ الطَّيِّبُ al-Kalim al-Tayyib (the goodly words), and الْعَمَلُ الصَّالِحُ al-Amal al-Saalih (the righteous deeds) exalt it (the goodly words i.e., the goodly words are not accepted by Allah unless and until they are followed by good deeds).
